• AI-powered editing assistance and content enhancement tools
• Professional workflow management for efficient project completion

3. User Accounts and Registration

3.1 Account Creation

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 13 years old to create an account (18+ for business features)
• One person or entity may not maintain multiple accounts

3.2 Account Security

• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access
• We recommend enabling two-factor authentication for enhanced security
• Account sharing is prohibited and may result in termination

3.3 User Types and Roles

• Creators: Can create projects, invite editors, and manage content
• Editors: Access projects by invitation and collaborate on editing tasks
• Team Accounts: Organizations with multiple users and admin controls

5.1 Your Content Ownership

• You retain all ownership rights to content you upload
• You are solely responsible for ensuring you have rights to all content

• This license ends when you delete content or terminate your account

5.2 Creator-Editor Content Relationships

• Creators retain ownership of original content and final edited videos
• Editor contributions become part of the creator's project unless separately agreed
• Access to creator content is governed by project permissions
• Editors may not use creator content outside the authorized project scope

5.3 Platform Intellectual Property

• PithPlay platform, features, and technology remain our exclusive property
• You may not reverse engineer, copy, or create derivative works
• Our trademarks and branding are protected intellectual property

6. AI and Automated Features

6.1 AI Tool Usage

• AI suggestions are tools to assist your work, not replace professional judgment
• You remain responsible for all final creative decisions and content quality
• AI-generated content must be reviewed before use in final projects
• Content processed by AI is not stored for training purposes

6.2 AI Limitations

• AI tools may produce imperfect results requiring human oversight
• Features are continuously evolving and may change over time
• No guarantee of specific AI feature availability or performance

7. Payment and Billing

7.1 Subscription Plans

• Multiple subscription tiers with different features and usage limits
• Monthly and annual billing options available
• Automatic renewal unless cancelled before renewal date
• Plan changes take effect at the next billing cycle

7.2 Payment Terms

• Payment is due at the beginning of each billing period
• We accept major credit cards and approved payment methods
• Failed payments may result in service suspension
• All fees are non-refundable except as required by law

7.3 Free Trial and Cancellation

• Free trials are available for eligible new users
• You may cancel your subscription at any time
• Cancellation stops future billing but access continues until period end
• Content access may be limited after subscription expiration

8. Service Availability and Support

8.1 Platform Uptime

• We strive for 99.9% uptime but cannot guarantee uninterrupted access
• Scheduled maintenance will be announced in advance when possible
• Emergency maintenance may occur without prior notice

8.2 Technical Support

• Support is provided via email and in-platform messaging
• Response times vary by subscription tier and issue complexity
• We provide documentation and tutorials for self-service support

9. Privacy and Data Protection

Your privacy is fundamental to our service. We collect, use, and protect your information in accordance with our comprehensive Privacy Policy.

10. Disclaimers and Limitations of Liability

• No guarantee of uninterrupted service or error-free operation

• AI features may produce unexpected or imperfect results
• Third-party integrations may affect platform performance

10.2 Limitation of Liability

To the maximum extent permitted by law, Artbits Solutions Ltd.'s total liability shall not exceed:

• $500 CAD, or
• The amount paid by you in the 12 months preceding the claim
• Whichever amount is greater

10.3 Excluded Damages

We are not liable for indirect, incidental, consequential, or punitive damages, including:

• Lost profits or business opportunities
• Data loss or corruption (beyond reasonable backup efforts)
• Third-party service interruptions
• Creator-editor relationship disputes

11. Indemnification

You agree to indemnify and hold harmless Artbits Solutions Ltd. from claims arising from:

• Your violation of these Terms or applicable laws
• Your content and any intellectual property infringement claims
• Your use of the Platform or interactions with other users
• Any breach of your representations and warranties

12. Term and Termination

12.1 Term

These Terms remain in effect while you use the Platform.

12.2 Termination by You

• You may terminate your account at any time through account settings
• Cancellation stops future billing but access continues until period end
• You may download your content before termination

12.3 Termination by Us

We may suspend or terminate your account for:

• Violation of these Terms or acceptable use policies
• Non-payment of fees
• Illegal activities or security threats
• Extended inactivity (with advance notice)

12.4 Effect of Termination

• Your right to access the Platform ceases immediately
• Content may be deleted after a reasonable grace period
• Outstanding payment obligations survive termination
• Confidentiality and intellectual property provisions survive

13. Changes to Terms

We may update these Terms to reflect changes in our service, legal requirements, or business practices.

13.1 Notification Process

• Material changes will be communicated via email and platform notification
• At least 30 days advance notice for significant changes
• Updated Terms will be posted on our website with revision date

13.2 Acceptance

• Continued use after changes constitutes acceptance
• If you disagree with changes, you may terminate your account

14. Governing Law and Dispute Resolution

• Disputes must be brought individually, not as class actions

14.3 Creator-Editor Disputes

Commercial disputes between creators and editors are governed by their separate agreements. Platform-related technical issues may be addressed through our support channels.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms, constitute the complete agreement between you and Artbits Solutions Ltd.

15.2 Severability

If any provision is found unenforceable, the remaining provisions continue in full effect.

15.3 Assignment

• You may not assign your rights under these Terms
• We may assign our rights and obligations without restriction

15.4 Waiver

Our failure to enforce any provision does not constitute a waiver of future enforcement.
